Bankruptcy is an important legal tool for anyone who borrows. Essentially, bankruptcy is aimed at providing one specific legal setting whereas all creditors can be heard and treated fairly in respect to the debts that are owed to them

 

As for individuals (or debtors, who are those who file for bankruptcy) bankrutcy provides protection and relief from debts owed to creditors.

 

Protection

 

Upon filing for bankruptcy, the debtor is provided the protection of the automatic stay. This precludes all creditors from collecting any debts owed to them by the debtor. As such, they are all required to state their claim or case within bankruptcy court. This provides many benefits for debtors who are being sued by numerous parties as it provides on venue for them to litigate their points.

 

Further, all assets owned under the estate are created upon filing of the bankruptcy petition, thereby protecting them from reach by any creditors, absent approval from the bankruptcy court.

 

Relief

 

Bankruptcy, ultimately, is aimed at providing relief for over indebted individuals and businesses. After all the assets are counted, the exemptions are excluded, should there be any remaining assets for distribution those assets can be liquidated and used to pay any outstanding balances.

 

Relief from debts and relief from creditors constantly hassling you directly, are some of the strongest types of relief provided under the Bankruptcy Code.
